By placing an order, you acknowledge and agree that:- Farmer Butcher operates an online marketplace connecting customers with independent Australian farmers, butchers, producers and suppliers.
- The seller responsible for supplying each product is identified on the relevant product page, farm profile, cart, checkout or order confirmation.
- You may cancel an order because you have changed your mind only if Farmer Butcher receives your cancellation request within 48 hours after payment is successfully processed.
- After the 48-hour cancellation period, the seller may have allocated livestock, carcass weight, butcher capacity, packaging, ingredients, freight capacity or production resources specifically to your order. Change-of-mind cancellations, reductions, substitutions and refunds are therefore not available after that period.
- Meat is a natural and perishable product. Weight, shape, colour, marbling, fat coverage, bone content, cut size and appearance may vary within the product description and any stated weight range.
- Delivery dates, preferred delivery days and processing windows are estimates unless Farmer Butcher or the seller expressly agrees in writing that a particular date is guaranteed.
- The 48-hour change-of-mind rule does not limit any right or remedy available under the Australian Consumer Law.

- Seller means the farmer, butcher, producer, supplier or other independent business identified as supplying a product.
- Product means meat, seafood where applicable, smallgoods, bones, offal, prepared meat products and any related product offered through the marketplace.
- Order means an order submitted and paid for through the marketplace.
- Australian Consumer Law or ACL means Schedule 2 of the Competition and Consumer Act 2010 (Cth).
2. Acceptance of these Terms
You accept these Terms when you:- place an order;
- complete payment;
- create or use an account;
- select a cut list or processing option;
- accept an offer through Farmer Butcher; or
- otherwise use the marketplace to purchase products.
3. Farmer Butcher’s marketplace role
Farmer Butcher provides marketplace services that may include:- displaying seller and product information;
- providing ordering and checkout technology;
- processing or facilitating payments;
- transmitting orders to sellers;
- administering customer communications;
- assisting with delivery and tracking information;
- recording product concerns;
- referring claims to the relevant seller; and
- administering refunds, credits, replacements or other remedies on behalf of a seller.
- accepting and fulfilling the order;
- livestock and product allocation;
- processing, butchering and preparation;
- compliance with applicable food and product requirements;
- ensuring the product corresponds with its description;
- supplying products of acceptable quality;
- addressing missing, faulty, unsafe or materially non-compliant products; and
- providing any remedy the seller is legally required to provide.
4. Orders and contract formation
An order is an offer by you to purchase the selected products from the identified seller. An order is accepted when:- payment is successfully authorised;
- an order confirmation is issued; and
- the order is accepted for fulfilment by the relevant seller.
- a product is unavailable;
- livestock or processing capacity is unavailable;
- a product, weight, delivery or price error has occurred;
- the seller cannot reasonably fulfil the order;
- the delivery address is outside the available area;
- payment has failed or appears unauthorised or fraudulent;
- the order breaches these Terms; or
- fulfilment would breach a law, safety requirement or supplier restriction.
5. Prices and payments
All prices are stated in Australian dollars and include GST where applicable unless clearly stated otherwise. You must pay:- the product price;
- packaging, processing or custom-cut charges;
- delivery and freight charges;
- payment-method charges that are clearly disclosed before payment;
- optional extras selected by you; and
- any other amount shown in the final checkout total.
- your use of that service is also subject to the provider’s terms;
- approval, repayment schedules and eligibility are determined by the provider;
- Farmer Butcher does not provide financial or credit advice;
- a refund may be processed through the payment provider; and
- the provider may take additional time to update or return your payments.
6. Change-of-mind cancellation period
6.1 The 48-hour cancellation window
You may request a change-of-mind cancellation within 48 hours after payment is successfully processed. The request must be received by Farmer Butcher before the exact 48-hour deadline through:- the designated cancellation function in your account;
- the Farmer Butcher support form; or
- the customer support email stated in these Terms.
6.2 Cancellations received within 48 hours
Where a valid change-of-mind cancellation request is received within the 48-hour period, Farmer Butcher will cancel the affected order and arrange a refund to the original payment method. The refund will normally be initiated within five business days. Your financial institution or payment provider may require additional processing time.6.3 After the cancellation deadline
Once 48 hours have passed, change-of-mind cancellations, refunds and order reductions are not available. This is because the seller may have:- allocated all or part of a live beast or carcass to the order;
- committed livestock to processing;
- booked butcher or production capacity;
- begun ageing, cutting, curing, smoking or preparation;
- ordered packaging or ingredients;
- rejected other customer orders based on allocated capacity;
- arranged refrigerated freight; or
- incurred other costs specifically for the order.
- you changed your mind;
- you ordered the wrong product;
- you selected the wrong size or quantity;
- you no longer require the product;
- you found a cheaper product elsewhere;
- your freezer does not have enough space;
- your personal plans changed;
- you did not read the product description;
- you misunderstood an approximate weight that was clearly disclosed; or
- another person in your household does not want the product.
6.4 Australian Consumer Law preserved
This clause only applies to change-of-mind requests. It does not apply where a product is faulty, unsafe, materially misdescribed, missing, not of acceptable quality or otherwise fails a consumer guarantee.7. Custom cuts and processing instructions
Custom cut lists and processing selections are instructions and preferences provided to the seller and butcher. You are responsible for checking your selections before completing payment. You acknowledge that:- one part of a carcass cannot always be used for multiple conflicting cuts;
- selecting one cut may reduce or remove the amount available for another cut;
- exact yields depend on the animal’s weight, conformation, fat coverage and bone structure;
- the butcher may make reasonable adjustments where a requested cut is not technically possible;
- cut quantities and individual pack weights are estimates unless expressly guaranteed;
- whole-animal, half, quarter and eighth packs naturally vary;
- sausages, mince, trim, bones and secondary cuts may vary according to the selected cut allocation; and
- butcher judgment may be required to produce a practical and safe result.
8. Natural product variation and approximate weights
Meat is a natural agricultural product and is not manufactured to identical dimensions. Unless a product is sold at an exact verified weight, all stated weights are approximate or represent an expected range. Natural variation may include differences in:- total weight;
- individual cut weight;
- cut shape and dimensions;
- marbling;
- fat coverage;
- bone size;
- colour;
- moisture content;
- ageing loss;
- trimming loss;
- carcass yield; and
- the ratio of steaks, roasts, mince, sausages, trim and bones.

- excess fat;
- hide, organs or other non-retail components;
- moisture and ageing loss;
- cutting and trimming; and
- customer-selected processing options.
9. Product availability and substitutions
All products are subject to livestock, seasonal, processing and seller availability. Farmer Butcher or the seller may offer a reasonable substitution where:- a particular cut is unavailable;
- actual carcass yield differs from the estimate;
- a reward product is unavailable;
- livestock does not meet the expected processing specification; or
- an unforeseen supply issue occurs.
10. Delivery
10.1 Delivery estimates
Processing windows, dispatch dates, preferred delivery days and delivery dates are estimates unless expressly confirmed in writing as guaranteed. Delivery can be affected by:- livestock availability;
- required ageing or hanging periods;
- butcher capacity;
- weather;
- road closures;
- courier schedules;
- regional delivery routes;
- public holidays;
- refrigeration requirements;
- biosecurity events; and
- circumstances outside reasonable control.
10.2 Preferred delivery days
A preferred delivery day is a request only. Selecting a preferred day does not guarantee delivery on that day unless expressly confirmed in writing.10.3 Delivery address
You must provide a complete and accurate delivery address, including:- unit or apartment number;
- street number and name;
- suburb;
- state;
- postcode;
- telephone number;
- access instructions; and
- safe-place instructions where required.
10.4 Authority to leave
Where you provide authority to leave, or the delivery method ordinarily permits safe-place delivery, the courier may leave the order at the nominated address in a reasonably safe location. Risk in the products passes to you when the order is delivered:- to you;
- to a person at the delivery address;
- to your nominated safe place; or
- in accordance with your delivery instructions.
10.5 Prompt refrigeration
You must arrange for delivered meat to be collected, inspected and refrigerated or frozen promptly. You should not leave perishable products unattended or unrefrigerated longer than reasonably necessary. Farmer Butcher and the seller are not responsible for deterioration caused after delivery by:- failure to collect the order promptly;
- leaving products exposed to heat or direct sunlight;
- inadequate refrigeration or freezer space;
- power failure at the customer’s premises;
- incorrect storage;
- thawing and refreezing; or
- handling contrary to the label or supplied instructions.
11. Inspection after delivery
You should inspect the order as soon as reasonably possible after delivery. Check:- package condition;
- product temperature and cold-chain condition;
- seals and vacuum packaging;
- product labels;
- quantities;
- cut selections;
- stated weights;
- missing items; and
- signs of damage, spoilage or contamination.
- retaining it would be unsafe;
- Farmer Butcher or the seller instructs you to dispose of it; or
- disposal is reasonably necessary.
12. Reporting missing, damaged or unsatisfactory products
Product concerns should be submitted through Farmer Butcher so that they can be recorded and referred to the appropriate seller. For perishable-product, missing-item, packaging, temperature or delivery concerns, you should contact Farmer Butcher as soon as reasonably possible, preferably within 24 hours after delivery. A report should include, where reasonably available:- your name and order number;
- the affected product;
- a clear description of the problem;
- photographs of the product;
- photographs of the packaging and label;
- photographs of any courier damage;
- the quantity or weight affected;
- the time the order was received;
- how the product was stored after delivery; and
- a temperature reading where temperature is relevant and one can safely be obtained.
- protect food safety;
- identify the relevant product and seller;
- investigate courier or packaging issues;
- determine whether a product has deteriorated after delivery;
- verify missing items or weight discrepancies; and
- provide an appropriate remedy.
13. Missing items
If an item is genuinely missing, the seller will provide an appropriate remedy. Depending on the circumstances, the remedy may include:- delivery of the missing item;
- a comparable replacement accepted by you;
- a refund for the missing item;
- a proportionate refund for a verified shortage; or
- another remedy agreed with you.
14. Product quality concerns
The following are not necessarily product failures:- normal colour differences between species, breeds, cuts or packaging methods;
- darkening or colour change associated with vacuum packaging;
- natural marbling or fat variation;
- differences in cut shape;
- small weight differences within a disclosed approximate range;
- bone fragments reasonably associated with bone-in cuts, provided the product remains safe and acceptable;
- moisture in vacuum packaging;
- minor packaging marks that do not affect product safety;
- reasonable butcher adjustments;
- personal taste preferences; or
- a dislike of a product that is otherwise safe, correctly described and of acceptable quality.
- unsafe or spoiled meat;
- contamination;
- a broken cold chain before delivery;
- significant packaging failure affecting safety or quality;
- a materially incorrect product;
- a material discrepancy from the agreed cut list;
- a material shortfall from an expressly promised minimum weight;
- undisclosed allergens;
- a product that does not match its description; or
- another failure to meet a consumer guarantee.
15. Remedies and refunds for product problems
The available remedy depends on the nature and seriousness of the problem and the requirements of the Australian Consumer Law. For a minor problem, the seller may choose to:- replace the affected product;
- supply the missing component;
- provide a proportionate refund;
- correct the issue; or
- provide another remedy within a reasonable time.
- the failure affects the order as a whole;
- the products cannot reasonably be separated;
- the failure is major in relation to the whole order; or
- the law otherwise requires it.
- that is not reasonably possible;
- the payment provider requires another process; or
- you agree to another method.
16. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with goods, you are entitled to choose a refund or replacement and may be entitled to compensation for other reasonably foreseeable loss or damage. If a failure with goods does not amount to a major failure, you are entitled to have the failure remedied within a reasonable time. If it is not remedied within a reasonable time, you may have further rights under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies:- a consumer guarantee;
- a right to a refund, replacement or other remedy;
- liability for reasonably foreseeable loss or damage;
- liability for unsafe goods;
- any right relating to misleading or deceptive conduct; or
- any other right or remedy that cannot lawfully be excluded.
17. Food safety, allergens and preparation
You must follow all product labels, storage instructions, use-by dates and safe food-handling requirements. Unless expressly stated otherwise:- products may be processed in facilities that also handle common allergens;
- sausages, marinades, cured products and smallgoods may contain allergens;
- product ingredients may vary between sellers;
- raw products must be cooked and handled appropriately; and
- products should not be consumed where packaging integrity or safety is reasonably in doubt.
18. Rewards, giveaways and promotions
Rewards, giveaways and promotional products:- are subject to availability;
- have no cash value;
- may require a stated minimum spend;
- may be limited to one per customer or order;
- may be substituted with a reasonably comparable product;
- cannot be transferred separately from the qualifying order; and
- may be withdrawn where the qualifying order is cancelled or refunded.
19. Accounts and customer information
You must provide accurate and current information. You are responsible for:- maintaining the security of your account;
- checking saved delivery addresses;
- checking contact details;
- keeping login information confidential; and
- notifying Farmer Butcher of unauthorised account activity.
- fraud;
- payment abuse;
- repeated false claims;
- abusive or threatening conduct;
- misuse of discounts or rewards;
- interference with the marketplace;
- unlawful activity; or
- a material breach of these Terms.
20. Prohibited conduct
You must not:- use the marketplace unlawfully;
- provide false or misleading information;
- place fraudulent orders;
- use another person’s payment method without authority;
- interfere with the website or checkout;
- introduce malicious code;
- scrape or extract marketplace data without permission;
- impersonate another person or seller;
- make knowingly false product claims;
- abuse Farmer Butcher personnel, sellers, couriers or other users; or
- use the marketplace in a way that infringes another person’s rights.
21. Chargebacks and payment disputes
You should contact Farmer Butcher promptly before initiating a chargeback so that the issue can be investigated and, where appropriate, resolved. This request does not restrict your right to contact your bank, payment provider or card issuer. You must not knowingly submit a false, misleading or fraudulent chargeback. Where a chargeback is found to be fraudulent or submitted after you have received and retained compliant products, Farmer Butcher or the seller may seek recovery of the unpaid amount and reasonable direct recovery costs to the extent permitted by law.22. Liability
Nothing in this clause limits liability that cannot lawfully be limited. To the maximum extent permitted by law:- Farmer Butcher is responsible for its own marketplace services, payment administration, conduct and representations;
- the seller is responsible for the products it supplies and its own conduct and representations;
- Farmer Butcher is not responsible for a seller’s conduct merely because Farmer Butcher provided marketplace technology or administrative assistance;
- liability will be reduced to the extent that loss was caused or contributed to by the customer’s conduct;
- a party must take reasonable steps to minimise loss; and
- neither party is liable for indirect or consequential loss except where that liability cannot lawfully be excluded.
- is itself legally the supplier;
- made the relevant representation;
- caused or contributed to the loss;
- breached a consumer guarantee applying to its services; or
- is otherwise legally responsible.
23. Events outside reasonable control
Farmer Butcher and sellers will not be liable for delay caused by events outside reasonable control, including:- extreme weather;
- floods, fires or natural disasters;
- animal health or biosecurity events;
- processing-facility closure;
- equipment breakdown;
- labour shortages;
- courier disruption;
- road closure;
- power or refrigeration failure;
- government action;
- disease outbreak;
- cyberattack; or
- telecommunications failure.
24. Complaints and disputes
Complaints should first be submitted to Farmer Butcher using the customer support details in these Terms. Farmer Butcher will:- record the complaint;
- identify the relevant seller;
- request supporting information where reasonably required;
- refer the complaint to the seller;
- assist communications;
- provide updates where reasonably practicable; and
- help administer an agreed or legally required remedy.
- seeking urgent legal relief;
- contacting a fair-trading authority;
- contacting the ACCC;
- using a tribunal or court;
- contacting a payment provider; or
- exercising any right available under law.
25. Privacy
Personal information is handled in accordance with Farmer Butcher’s Privacy Policy. You acknowledge that information reasonably required to fulfil or investigate an order may be shared with:- the relevant seller;
- the processing butcher;
- couriers and logistics providers;
- payment providers;
- technology providers;
- insurers;
- professional advisers; and
- regulators or authorities where required by law.
26. Intellectual property
All Farmer Butcher trademarks, branding, website content, software, designs, photographs and marketplace materials remain owned by Farmer Butcher or its licensors. Seller content remains owned by the seller or its licensors. You may use marketplace content only for personal, non-commercial purposes unless written permission is provided. You must not copy, sell, reproduce, scrape, distribute or commercially exploit marketplace content without permission.27. Changes to these Terms
Farmer Butcher may update these Terms from time to time. Changes will apply prospectively from the stated effective date. The Terms applying to an accepted order will be the Terms presented when that order was placed unless:- the change is required by law;
- the change benefits the customer; or
- the customer agrees to the change.
28. General provisions
28.1 Entire agreement
These Terms, the relevant product page, seller information, checkout selections, order confirmation and incorporated policies form the agreement relating to the order.28.2 Inconsistency
Specific written product or order terms prevail over these general Terms to the extent of any direct inconsistency. No specific term may exclude a right that cannot lawfully be excluded.28.3 Severability
If a provision is invalid or unenforceable, it will be read down to the minimum extent necessary. If it cannot be read down, it will be severed without affecting the remaining provisions.28.4 No waiver
A failure or delay in exercising a right does not waive that right.28.5 Assignment
You may not transfer an order or your rights under these Terms without consent. Farmer Butcher may transfer its rights and obligations as part of a genuine business restructure, sale or transfer, provided this does not materially reduce your rights.28.6 Governing law
These Terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts and tribunals of New South Wales and any courts entitled to hear appeals from them. This clause does not prevent a consumer from relying on any mandatory right available in another Australian jurisdiction.29. Contact details

Detailed Delivery Conditions
These detailed delivery conditions form part of the Farmer Butcher Marketplace Terms and Conditions.DELIVERY, CUSTOMER DETAILS, AUTHORITY TO LEAVE AND RESPONSIBILITY AFTER DELIVERY
1. Perishable-product delivery
Farmer Butcher products are perishable and require prompt collection, inspection and refrigeration or freezing. By placing an order, you acknowledge that:- meat may be delivered in refrigerated, insulated or temperature-controlled packaging;
- someone should be available to receive or promptly collect the delivery;
- the order must not be left unattended longer than reasonably necessary;
- the products must be refrigerated or frozen promptly after delivery; and
- delays in collecting, opening, checking or storing the order may affect product quality and safety.
2. Customer responsibility for checkout information
You must carefully review all delivery information before completing payment. You are responsible for ensuring that the following information is complete and correct:- recipient’s full name;
- email address;
- mobile telephone number;
- unit, apartment, shop or building number;
- street number and street name;
- suburb;
- state;
- postcode;
- business name, where applicable;
- gate, building or property access information;
- safe-place instructions;
- delivery notes; and
- any other information reasonably required to complete the delivery.
- an incorrect street number;
- an incorrect unit or apartment number;
- an incomplete address;
- an incorrect suburb, state or postcode;
- an old or previously saved address;
- an address entered accidentally;
- an incorrect telephone number;
- an incorrect email address;
- a misspelled recipient name;
- missing access instructions;
- locked gates or inaccessible buildings;
- an unsafe or unsuitable delivery location;
- a failure to provide a business name;
- a failure to identify a unit, reception area or loading area;
- a failure to answer telephone calls, messages or intercom requests;
- a failure to monitor tracking information; or
- any other incorrect or incomplete information supplied by you.
3. Changes to delivery information
You must notify Farmer Butcher immediately if you discover an error in your delivery information. A request to change an address, telephone number, recipient or delivery instruction is not effective unless Farmer Butcher confirms in writing that the change has been accepted and processed. Farmer Butcher cannot guarantee that a change can be made after:- the order has been transmitted to the seller;
- shipping labels have been generated;
- the order has been packed;
- a courier booking has been created;
- the consignment has been collected;
- the order has entered the courier network; or
- delivery has commenced.
4. Customer availability and contact
The courier is not required to contact you before attempting delivery unless that service is expressly included. Telephone calls, text messages, emails, tracking notifications and delivery alerts are provided as a convenience. They are not a condition of valid delivery. A delivery will not become invalid merely because:- you did not receive a tracking message;
- an email was filtered into spam;
- your telephone was switched off;
- you did not answer a telephone call;
- the courier did not telephone before arriving;
- you did not hear the doorbell or intercom;
- you were away from the premises; or
- another person received the order.
5. Authority to leave
Unless you expressly select a signature-required service that Farmer Butcher confirms is available, you authorise the courier to leave the order at the nominated delivery address without obtaining a signature. This authority includes leaving the order:- at the front door;
- at a side or rear door;
- at a reception area;
- with concierge or building management;
- at a mailroom;
- in another location nominated in your instructions;
- with a person who appears authorised to receive deliveries at the premises; or
- in another location the courier reasonably considers safe, sheltered and accessible.
6. When delivery is completed
Delivery is completed when the order is:- handed to you;
- handed to a person at the nominated address;
- handed to reception, concierge, building management or another person who appears authorised to accept it;
- left at the safe place nominated by you;
- left at the nominated address in a location the courier reasonably considers safe; or
- otherwise delivered in accordance with your instructions.
- you entered the wrong address;
- you no longer live or work at that address;
- another resident, employee or occupant accepts the order;
- you failed to include a unit or apartment number;
- you failed to update a previously saved address; or
- the address belongs to another person,
7. Proof of delivery
Courier records may be used as evidence that delivery was attempted or completed. These records may include:- delivery scans;
- timestamps;
- GPS information;
- tracking events;
- driver notes;
- delivery photographs;
- signatures;
- safe-place records;
- communications with the recipient; and
- courier-system records.
8. Transfer of risk after valid delivery
Subject to the Australian Consumer Law, responsibility for the care, security, handling and storage of the products passes to you when delivery is completed under these Terms. After valid delivery, Farmer Butcher and the seller are not responsible for loss, damage, deterioration, spoilage or contamination caused or contributed to by:- theft;
- animals;
- insects;
- another resident or occupant;
- building staff;
- neighbours;
- members of the public;
- direct sunlight;
- rain, wind or weather;
- heat exposure after delivery;
- delayed collection;
- failure to open the package promptly;
- failure to refrigerate or freeze the products promptly;
- insufficient refrigerator or freezer space;
- refrigerator or freezer malfunction;
- power failure at the delivery premises;
- improper storage;
- puncturing or damaging the packaging;
- thawing and refreezing;
- cross-contamination;
- failure to follow label or storage instructions; or
- any act or omission occurring after valid delivery that is outside Farmer Butcher’s or the seller’s reasonable control.
9. Incorrect addresses
Where you provide an incorrect or incomplete delivery address:- Farmer Butcher is not required to replace or refund an order delivered to that address;
- the courier may be unable to retrieve or redirect the order;
- any attempted recovery will be undertaken only where reasonably possible;
- recovery cannot be guaranteed;
- perishable products may be unsuitable for redelivery;
- a new order may be required;
- additional delivery, redirection, retrieval, storage or disposal charges may apply; and
- you may remain responsible for the original order price.
10. Incorrect telephone numbers and failed contact
You must provide a valid Australian mobile telephone number that can receive calls and text messages. Farmer Butcher and the seller are not responsible for a failed or delayed delivery caused or contributed to by:- an incorrect telephone number;
- a disconnected telephone number;
- a telephone number belonging to another person;
- a full voicemail inbox;
- call-blocking settings;
- text-message filtering;
- failure to answer calls or messages;
- failure to respond within the time reasonably required by the courier; or
- failure to update your contact details.
11. Apartments, units, gated premises and businesses
For apartments, units, gated properties and commercial premises, you must provide all information reasonably required for access. This may include:- unit or suite number;
- building name;
- entry code;
- gate instructions;
- intercom details;
- floor number;
- reception hours;
- loading-dock instructions; and
- the name of the business or recipient.
- wait an unreasonable period for access;
- enter an unsafe property;
- climb locked gates;
- enter an area prohibited by building rules;
- leave the vehicle unattended where unsafe;
- carry products an unreasonable distance;
- search for an unidentified unit or business; or
- repeatedly attempt contact.
12. Dogs, animals, hazards and unsafe premises
You must ensure that the delivery location is safe and accessible. The courier may refuse to enter a property or complete delivery where there is:- an unsecured dog or other animal;
- threatening or abusive conduct;
- unsafe access;
- flooding, fire or another hazard;
- an unsealed or impassable road;
- inadequate lighting;
- restricted access;
- a dangerous driveway;
- a locked gate;
- a biosecurity restriction; or
- another reasonable safety concern.
13. Failed delivery caused by the customer
A delivery is customer-caused where the courier cannot reasonably complete delivery because of:- inaccurate or incomplete information;
- inability to access the property;
- inability to identify the premises;
- failure to provide required instructions;
- failure to answer an intercom;
- refusal to accept the order;
- an unsafe delivery location;
- an unsecured animal;
- the recipient not being available where personal delivery was required; or
- another act or omission within the customer’s control.
- a refund is not automatically available;
- you may be charged for the original delivery attempt;
- additional redelivery, handling, storage and administration charges may apply;
- redelivery is subject to product safety and courier availability; and
- the products may be disposed of where they cannot safely be redelivered.
14. Courier delays
Delivery dates and preferred delivery days are estimates unless expressly guaranteed in writing. Farmer Butcher and the seller are not responsible for delay caused by events outside their reasonable control, including:- courier network disruption;
- vehicle breakdown;
- weather;
- road closure;
- flooding;
- bushfire;
- public holidays;
- regional delivery schedules;
- labour shortages;
- refrigeration-equipment failure;
- government restrictions;
- natural disasters; or
- other emergency events.
15. Temperature and product condition
Products may arrive chilled, partially frozen or frozen depending on the product, seller, processing method and delivery arrangement. A product is not automatically defective because:- it is colder or warmer than expected;
- ice packs have partially melted;
- the outer carton is damp;
- vacuum-packed meat appears darker;
- products have shifted during transportation; or
- some products are frozen while others are chilled.
- do not consume it;
- refrigerate or freeze it where safe to do so;
- retain the packaging and labels;
- take clear photographs;
- record the delivery time;
- take a temperature reading where one can safely and reasonably be obtained; and
- contact Farmer Butcher promptly.
16. Delivery claims
You should report:- non-delivery;
- delivery to the wrong address;
- material courier damage;
- missing boxes;
- unsafe temperature;
- packaging failure;
- suspected spoilage; or
- another delivery problem
- order number;
- customer name;
- delivery address;
- description of the problem;
- photographs;
- packaging and label photographs;
- tracking information;
- delivery time;
- temperature information where relevant; and
- any other evidence reasonably required to investigate.
17. Matters Farmer Butcher remains responsible for
Nothing in this delivery section excludes or limits responsibility for:- delivering to an address different from the address supplied by the customer without reasonable justification;
- loss or damage occurring before valid delivery;
- failure to exercise reasonable care in arranging marketplace or delivery services;
- unsafe products;
- products that fail to comply with a consumer guarantee;
- misleading or deceptive conduct;
- negligence to the extent liability cannot lawfully be excluded;
- deliberate misconduct; or
- any right, guarantee, remedy or liability that cannot lawfully be excluded under the Australian Consumer Law.
CHECKOUT DELIVERY ACKNOWLEDGEMENT
By placing my order, I confirm that:- I have checked my recipient name, mobile number, email address and complete delivery address.
- I have included any required unit number, business name, access code and delivery instructions.
- I understand that Farmer Butcher may not be able to change my address after processing or dispatch begins.
- I authorise the courier to leave the order at the nominated address or a reasonably safe location where signature delivery has not been expressly arranged.
- I understand that delivery notifications are provided as a convenience and that the courier is not required to telephone me before delivery.
- I understand that responsibility for the security, handling and storage of the products passes to me after valid delivery.
- I understand that Farmer Butcher is not responsible for theft, weather exposure, delayed collection, inadequate refrigeration or other deterioration occurring after valid delivery.
- I understand that I may be responsible for redelivery, redirection, storage, recovery or replacement costs where I supplied incorrect information or prevented delivery.
- I understand that nothing in this acknowledgement limits my rights under the Australian Consumer Law.
